Lawyer and Anti Money Laundering (AMLA) Law in Malaysia

Knowledge Sharing : Lawyers  and  AMLA in Malaysia.

Lawyers  are classified as a Reporting  Institutions  under Designated Non Financial  Businesses and Professions (DNFBPs)

So? 
They  are required  by Law to undertake preventive measures to prevent  their Institutions  from being used as a conduit for Money  Laundering  and Terrorism  Financing Activities including:
1) carrying Out risk assessment
2) Conducting Customer Due Diligence
3) Submitting Suspicious Transaction Report and Cash Threshold Report (Financial Institution and Casino)
4) Maintaining and retaining records of transaction and ;
5) implementing Anti-Money Laundering and Countering Financing of Terrorism (AML/CFT) compliance programme  based on ML/TF risk exposure, it's size, nature and complexity 

Bar Council  Malaysia has issued Circular No.  119/2018 dated 8 May 2018 about good practices and common lapses identified by Bank Negara Malaysia (BNM)  during previous on site examination. 

The good practices were:๐Ÿ˜€๐Ÿ‘

(1) maintenance and centralisation of customer database at the law firm level;

(2) adequate management information system (“MIS”) using both manual records and a
simple system to capture customer due diligence (“CDD”) and transaction records,
commensurate with the firm’s size and complexity; and 

(3) retention of basic CDD and transaction records for at least six years. 

The lapses identified were:๐Ÿ†˜๐Ÿ‘ฎ๐Ÿง

(1) lapses in Enhanced Customer Due Diligence (“EDD”) on higher-risk customers due tothe absence of / inadequate customer risk profiling;

(2) absence of transaction monitoring on clients;

(3) gaps in establishing internal criteria (“red flags”) to detect suspicious transactions and 
reporting mechanisms for suspicious transactions;

(4) lapses in maintaining a database of names and details of sanctioned individuals and 
entities;

(5) lapses in conducting checks on the names of new and existing clients against the list
of sanctioned entities; 

(6) lapses in money laundering / terrorism financing (“ML/TF”) risk assessment in 
relation to the firm’s customers, products, and services, transactions or delivery 
channels and geographical presence;

(7) absence of / inadequate risk profiling of clients;

(8) absence of written AML/CFT policies and procedures on key areas of AML/CFT 
requirements;

(9) absence of senior management oversight on AML/CFT matter

10) Gaps in conducting AML/CFat awareness  and training  programme  for employees and

11) Gaps in appointing a Compliance Officer to undertake COMPLIANCE Function for AML/CFT matters.

Knowledge Sharing: CHARGES.

Introduction:
The word ‘charge’ is not defined in the Criminal Procedure Code (CPC).
A simple understanding would be that a specific accusation made against a person of an offence  alleged  to   have   been   committed   by  him.

When a person is said to be charged with an offence, he is in fact called to appear before a magistrate or judge and informed of the charge or complain against him. How? The Deputy Public Prosecutor (DPP )would request the court to read out the charge, the charge would be read out  in a language which the accused understood.

Purpose of a charge:
a) Give a notice to the accused on what they are charged and it allows the accused to prepare   his   case.   (Prepare   for   his   defence)
The   DPP  must   give   a   clear   charge.(Sufficient clearness + clarity must be given to the accused to know what offence hasbeen alleged against him)

b) Information to the court, so when the trial was going on, the court would know what evidence to seek out for and required.

c) Indicate the punishment to be imposed.

d) Indicate the jurisdiction of the court.

Case studies:
1) Mahomed Humayoon Shah v Regina
Judgement : A charge has to be specific and detailed.  (No vague charge is allowed) If vague charge= improper charge. If you have a defective charge, you need to revisit it.

2)  PP v Lee Pak
Judgement: Charge is a notice to the accused that must be conveyed with sufficient clearness and certainty in which the prosecution intends to prove against him and he will have to clear himself.

3) Jagar Singh v PP
Accused must know exactly the charge he has to answer and what is the offence for which he has been convicted.

4) PP  v   Chung   Tshun   Tin   &   Ors Accused   must   be   informed   with  certainty   and accuracy or else he may be severely prejudiced to his defence.

Form of Charges: (with clarity + certainty)

1) A charge: state the offence with which A is charged; the law and the punishable section of the law; the time and date of the offence; the place and the particulars of the thing; and the   manner   in   which   the   alleged   offence   was   committed   if   particulars   are insufficient.

2)Charge must contain the offence  If   is   known   as   CBT/   some   offences   which   is   clear. Examples; rape/murder/robbery/ cheating. Such specific name of the offence may be described.

(3) If no specific name, then DPP need to bring in the definition of the offence.

(4) Must mention the section of the offence which the accused was charged.

Muzakarah Jawatankuasa Fatwa Majlis Kebangsaan Bagi Hal Ehwal Ugama Islam Malaysia Kali Ke-69 yang bersidang pada 13-15 Jun 2005 di Johor Bahru telah membincangkan Hukum Skim Cepat Kaya dan Seumpamanya. Muzakarah telah memutuskan bahawa:
Hukum terhadap Skim Cepat Kaya adalah haram kerana ia mengandungi unsur-unsur judi, riba, gharar dan tadlis dan umat Islam dilarang daripada terlibat dengan skim ini

TUJUAN
1. Pekeliling Perkhidmatan ini bertujuan untuk menyampaikan keputusan Kerajaan berhubung larangan penglibatan pegawai awam dalam skim cepat kaya.Dengan ini Kerajaan telah memutuskan bahawa pegawai awam dilarang
sama sekali terlibat dalam mana-mana skim cepat kaya termasuk sebagai
penganjur atau pengantara atau pelabur.

Pegawai awam yang melabur dalam skim cepat kaya akan dikenakan tindakan tatatertib kerana boleh diertikan / ditafsirkan sebagai bersubahat atau bersekongkol dengan penganjur atau pengantara skim tersebut. Pegawai yang ingkar dengan larangan ini akan dikenakan tindakan tatatertib di bawah Peraturan-Peraturan Pegawai Awam (Kelakuan dan Tatatertib) 1993 atau peraturan-peraturan lain yang berkuat kuasa.

Knowledge Sharing : Proliferation Financing & Strategic Trade Act 2010.

Proliferation financing in simple words refers to the provision of funds or financial services that are used to support the manufacture, acquisition, possession, development, export, transfer, or use of weapons of mass destruction (WMDs) and their means of delivery, including nuclear, chemical, or biological weapons, in violation of national laws or international obligations.

The objective of proliferation financing is to circumvent international sanctions, export controls, and other regulatory measures put in place to prevent the spread of WMD. It involves illicit financial networks, front companies, and deceptive practices to hide the true nature of the transactions and evade detection.

Proliferation financing can take various forms, including:

1) Procurement:
Financial activities related to the acquisition or attempted acquisition of WMD-related goods and technologies, such as materials for nuclear enrichment, missile components, or chemical precursors.

2) Logistics and transportation:
Financing the movement of WMD-related items, including arranging shipping, insurance, and related financial services to facilitate their transport.

3)Money laundering:
Concealing the origins of funds used for proliferation purposes through complex transactions and illicit networks to make the money appear legitimate.

4)Trade-based activities:
Manipulating trade transactions, misrepresenting goods, or using fraudulent documentation to disguise the movement of WMD-related items or illicit funds.

5) Front companies and intermediaries: Establishing legitimate-looking businesses or individuals to act as intermediaries or cover for the proliferation activities, providing a faรงade of legitimate trade or investment.

To counter proliferation financing, countries and international organizations have implemented various measures, including sanctions, export controls, and enhanced financial regulations to detect and disrupt these illicit activities.

What is the Strategic Trade Act 2010? 

Strategic Trade Act is an Act to provide for control over the export, transshipment, transit and brokering of strategic items, including arms and related material, and other activities that will or may facilitate the design, development and production of weapons of mass destruction and their delivery systems and to provide for other matters connected therewith, consistent with Malaysia’s national security and international obligations.

Why we should have the Act?
In 2004, the United Nations Security Council passed a Resolution which requested member countries to establish an export control system for the purpose of non-proliferation of weapons of mass destruction. As a member country, we are requested to control exports of strategic products which may be used for terrorism activities.

Why should I be concerned with export control compliance?
A person or entity that violates the Act can be subject to a fine, imprisonment and / or death sentence as provided in the STA 2010.
Non -Compliance, with STA 2010 is also predicate offence under AMLA 2001.

What are the strategic items?
Strategic items refer to goods and technology that are controlled under the STA. A definitive and comprehensive List of controlled strategic items will be prescribed in the Ministerial Order and published in the Government Gazette. The List will be reflective of the items currently required to be controlled under the global export control regimes as well as the United Nations Security Council Resolution 1540.

The items are categorized as follows:
1)nuclear materials, facilities and equipment;
2)special materials and related equipment;
3)electronics;
4)computers;
5)telecommunications and information security;
6)sensors and lasers;
7)navigation and avionics;
8)marine;
9)aerospace and propulsion; and
10)military items.

Perkongsian Ilmu - Kesalahan rasuah oleh organisasi komersial

Seksyen 17A Akta SPRM 2009 memperuntukkan  kesalahan rasuah oleh organisasi komersial (Liabiliti Korporat). Melalui peruntuukan seksyen 17A ini, organisasi komersial juga mempunyai liability dan boleh dihukum sekiranyan pekerja atau kakitangannya terbabit jenayah rasuah

Kajian KPMG Malaysia Fraud, Bribery and Corruption Survey 2013 mendapati 71 peratus responden mengatakan, perniagaan tidak dapat dijalankan di Malaysia melainkan dengan membayar sejumlah rasuah.Rasuah bukan hanya masalah negara kita. Jenayah tanpa mangsa atau ‘victimless crime’ ini adalah masalah global. Dalam skop yang lebih luas, Transparency International menganggarkan, dunia kerugian sebanyak USD2.6 trilion setiap tahun kerana rasuah. Sejumlah USD1 trilion rasuah dibayar untuk pelbagai tujuan. Pertubuhan tersebut turut menyatakan, rasuah menyebabkan penambahan 10 peratus ke atas kos untuk menjalankan perniagaan.

Bila ia berkuatkuasa?
Pada 5 April 2018, Parlimen meluluskan pindaan Akta SPRM 2009 bagi mengukuhkan undang-undang berkaitan pencegahan rasuah di Malaysia. Undang-undang ini telah berkuat kuasa mulai 1 Jun 2020 iaitu selepas dua tahun kelulusan Parlimen. 

Seksyen 17A Akta SPRM 2009 menyatakan:
(1) Suatu organisasi komersial melakukan kesalahan jika seseorang yang bersekutu dengan organisasi komersial itu secara rasuah memberikan, bersetuju untuk memberikan, menjanjikan atau menawarkan kepada mana-mana orang apa-apa suapan sama ada bagi faedah orang itu atau bagi faedah orang lain dengan niat -
(a) untuk memperoleh atau mengekalkan perniagaan bagi organisasi komersial itu; atau
(b) untuk memperoleh atau mengekalkan faedah dalam menjalankan perniagaan bagi organisasi komersial itu.

Hukuman
Hukuman boleh dikenakan kepada (1) individu yang melakukan rasuah; (2) pengurusan organisasi yang mengarahkan atau membenarkan perlakuan rasuah itu dibuat; dan (3) organisasi komersial itu sendiri.

Sekiranya didapati bersalah, organisasi komersial atau individu yang terlibat boleh didenda tidak kurang 10 kali ganda nilai suapan, atau RM1 juta, mengikut mana-mana yang lebih tinggi; atau dipenjarakan tidak melebihi 20 tahun;atau kedua-duanya sekali

Bagaimana Mengelakkan liabiliti korporat?

Garis Panduan Tatacara T.R.U.S.T :
1. Prinsip pertama: Top level commitment (Komitmen pengurusan atasan)
2. Prinsip kedua: Risk assessment (Analisa risko)
3. Prinsip ketiga: Undertake control measures (Pelaksanaan langkah kawalan)
4. Prinsip keempat: Systematic review, monitoring and enforcement (Pemantauan, penilaian dan penguatkuasaan secara sistematik)
5.  Prinsip kelima: Training and communication (Latihan dan komunikasi)

Antara contoh kes(luar negara): Rolls-Royce

Rolls-Royce didakwa membayar jutaan pound bagi memperoleh kontrak kejuruteraan awam dan ketenteraan di beberapa buah negara. Rasuah dibayar oleh pegawai Rolls-Royce sendiri atau melalui orang tengah, dari tahun 1999 sehingga 2013.

Pada Januari 2017, melalui prosiding Deferred Prosecution Agreement (DPA), Rolls-Royce bersetuju membayar penalti sebanyak £671 juta bagi mengelakkan pendakwaan oleh pihak berkuasa United Kingdom, Amerika Syarikat dan Brazil. Walaupun Rolls-Royce telah dikenakan penalti, perkara itu tidak menghalang individu yang terlibat didakwa di mahkamah.

Pada November 2018, tiga bekas pegawai Rolls-Royce dan seorang pekerja syarikat perunding yang bertindak bagi pihak Rolls-Royce mengaku bersalah atas dakwaan rasuah. Turut didakwa adalah ‘orang tengah’ yang dilantik oleh Rolls-Royce.

Modus Operandi Penipuan

Perkongsian Ilmu : Modus Operandi Penipuan @ Scam di mana akaun  bank anda dikatakan telah dibekukan  dibawah Akta Pencegahan Pengubahan Wang Haram (AMLA)

Apa yang anda (masyarakat  umum)  perlu tahu agar tidak menjadi mangsa Penipuan  @scam ini:

1) Pihak Berkuasa seperti PDRM, SPRM,  Bank Negara Malaysia dan  lain2 TIDAK AKAN membuat panggilan telefon kepada individu dan maklumkan akaun bank mereka disyaki terlibat dalam aktiviti pengubahan wang haram (AMLA)  dan akan dibekukan.

2) Pihak Berkuasa TIDAK AKAN memberi arahan kepada individu untuk memindahkan wang mereka ke dalam akaun pihak ketiga bagi tujuan siasatan / audit yang bersifat sementara.

3) Untuk makluman anda maklumat perbankan adalah rahsia di bawah Akta Perkhidmatan  Kewangan 2013 dan  Akta Perkhidmatan  Kewangan Islam 2013.

4)Seandainya jika anda telah di siasat,  Pengawai Penyiasat akan menyerahkan dokumen  Perintah Pembekuan dibawah seksyen 44  Akta AMLA yang mana ada tercatat nama pengawai  penyiasat  dan agensi penguatkuasa. Anda boleh menghubungi pegawai penyiasat untuk mendapat maklumat lanjut.

5) sekiranya  anda menerima panggilan  telefon yang mencurigakan, anda perlulah buat due diligence  @ tanya soalan kepada pemanggil tersebut. Berhati-hati jangan memberi  maklumat kepada mereka.

6) kadang kala scammer ni telah buat profiling terhadap anda melalui pelbagai sumber khususnya  di media sosial

FATF has called for countries to use a “multipronged approach” to ensure that “adequate, accurate and up-to-date” beneficial ownership information is available to competent authorities. This multipronged approach requires both companies and the government to collect and maintain beneficial ownership information, the latter through a beneficial ownership registry or alternative mechanism.

FATF made clear that beneficial ownership information should be verified. It also revised Recommendation 24 to require that countries assess the money laundering and terrorist financing risks for foreign-created legal persons with sufficient links to their country, and take steps to manage and mitigate these risks.

1) Why Reporting Institution and Financial Institutions need to identify BO?

A) The main reason for identifying the UBO is that it enhances a business' regulatory compliance position. Conducting thorough due diligence will also help identify any individuals who have been previously flagged with money laundering activities.

B)ask yourself- To what extent do you know the ownership structure and control structure of the entities?

C) Money launderer/ Fraudster / Corrupted person will always hiding or conceal their identity by complex structure or controlling

3) How to identify BO?
Rule no 1- BO must be a person and cannot be an entity.

Rule no 2- Identify individual holding 25% interest/ ownership (Direct and Indirect interest /ownership). Have you validate the info? .If no person holding 25% then only move to rule no 3.

Rule no. 3 - individual who has controlling power on the entity (such as authorized signatory or have influence to appoint or remove any Directors / Senior Management. Have you validate the info? If cannot identify...move to rule no 4.

Rule no 4- Senior Management of the entity such as CEO or equivalent, COO or equivalent,CFO or equivalent, Chairman, Secretary or Treasurer, depends on the structure of the entity.

Tips to identify BO ; (ask yourself);
1) Have you demonstrate your best effort in identifying the BO.

2) Do you really you know the ownership structure and control structure of the entities?

In 2022, 242,914 Suspicious Transaction Report (STRs)  were received, a 27% increase from 2021. Both STRs on fraud and money laundering offences continued to increase. High-risk crimes represent approximately 70% of the FIU’s disclosures to law enforcement agencies and foreign FIUs.

 The remaining 30% involved other crimes such as tax offences, human trafficking and illegal remittance. These disclosures resulted in the arrests of 51 individuals, freezing and seizing of assets of more than RM570 million as well as revenue recovery of RM372 million in relation to crimes such as organised crimes and tax offences.  

High risk crimes refer to fraud, corruption, organised crimes,smuggling and drugs trafficking, as identified under the National
Risk Assessment on ML/TF 2020.

 In addition, terrorism, terrorism
financing and proliferation financing are also deemed as priority from national security perspective.
